The Sardinian
administrative court (TAR Sardegna v. 27 July 220 375/20) declared inadmissible
the withdrawal of a German driving licence from a driver who had missed the
deadline for re-registering his licence (two years after moving from Germany to
Italy). He did not submit the application until four years later, after which
the authority withdrew his licence. The Italian judges consider that, although
an administrative offence is committed which is punishable by a fine, driving
disqualifications may be imposed only where there are reasonable doubts as to
the applicant's fitness to drive. These were not present in the case decided
and the driving licence had to be reissued.
